1. Agreement to Terms
By accessing or using Chalco ("the Service"), operated by Chalco Platform LLC ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Chalco is a fan-driven challenge platform that enables creators to launch challenges and fans to participate, vote, and donate. The Service includes challenge creation tools, submission management, leaderboards, and donation processing.
3. Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement and that all information you provide is accurate and complete.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use at contact@chalco.app.
5. Creator Subscriptions
Creators may subscribe to paid plans (Pro at $29/month, Creator+ at $79/month). Subscriptions are billed monthly and renew automatically. You may cancel at any time; cancellation takes effect at the end of the current billing period. All fees are non-refundable except where required by law.
6. Donations and Platform Fees
When fans donate to a challenge, Chalco Platform LLC retains a 10% platform fee. The remaining 90% is transferred to the creator's connected Stripe account. Donations are processed by Stripe and are subject to Stripe's Terms of Service. Chalco does not guarantee the processing of any donation.
7. User Content
You retain ownership of content you submit. By submitting content, you grant Chalco a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content in connection with operating the Service. You are solely responsible for ensuring your content does not violate any third-party rights or applicable laws.
8. Prohibited Conduct
You agree not to: (a) post content that is unlawful, harmful, or infringes third-party rights; (b) impersonate any person or entity; (c) attempt to gain unauthorized access to the Service; (d) use the Service for spam or unsolicited communications; (e) engage in any activity that disrupts or interferes with the Service.
9. Termination
We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may delete your account at any time by contacting us.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHALCO PLATFORM LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.
12. Governing Law
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Wyoming.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page with an updated effective date. Continued use of the Service after changes constitutes acceptance.
